Terms & Conditions of BLD Group Plc

This site . (“the Site”) is operated by BLD Group Plc (“BLD”) a company incorporated under the laws of England, company number 05957000. BLD’s registered office is at Unit 3A Carvers Industrial Estate, Southampton Road, Ringwood BH24 1JR.

As a user of the Site, you acknowledge and agree that any use of the Site (“use/ using”) is subject to our terms and conditions below. If you do not wish to accept these terms and conditions, please do not use the Site.

Please read through these terms and conditions carefully every time you use the Site, in particular your attention is drawn to Section 6 Liability & Indemnity, also read our Privacy Policy section regarding your personal information.

These terms apply to the Site and any other website operated by BLD or any associated companies. “BLD” shall for the purpose of these terms and conditions refer to BLD Group Plc or any other associated company.

1. General

BLD reserves the right to change these terms and conditions at any time. Any such changes will take effect when posted on the Site (see date at the top) and it is your responsibility to read the terms and conditions on each occasion you use the Site. Your continued use of the Site shall signify your acceptance to be bound by the latest terms and conditions.

If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you use the Site.

2. Company information

Neither BLD Group Plc or any associated company accepts any liability for the other companies’ or any other group company’s products, services or other actions.

3. Complaints

4. Intellectual Property

You acknowledge and agree that all site designs, text, graphics, software compilations and other contents/arrangements on the Site are the copyright of BLD and its affiliates. All rights reserved. No permission is granted including reproduction, modification, distribution, or republication purposes without our prior written permission.

All brand names, product names and titles used in the Site are trade marks or trade names of BLD or other respective holders. No permission is given in respect of the use of any of these names or titles and moreover any such use may constitute an infringement of the holders' rights.

5. Website Content

You acknowledge that not all of the Site content is monitored by BLD and that BLD is not responsible for any content submitted to the Site by any third party.

In submitting content to the Site you acknowledge that such a submission is in accordance with these terms and conditions. BLD reserves the right to monitor any Site content and to remove or amend any content that appears to be in breach of the terms and conditions of use or that BLD may at its absolute discretion object to.

BLD shall be able to use any content submitted to the website for any purpose it may think fit.

All content submitted to the website is done so entirely at your own risk. You agree that any content uploaded will not be unlawful, harmful, threatening, abusive, in breach of any law within the United Kingdom or otherwise, include any unauthorised advertising or be in breach of any other terms or conditions of the use of the Site.

6. Online Competitions

The rules (“Competition Rules”) set out below apply to each competition BLD runs on the Site.

By participating in each competition the user as an entrant agrees to be bound by the Competition Rules (and any other rules which BLD tell you apply to the competition) and by the decisions of BLD, which are final in all matters relating to the competition.

No correspondence will be entered into and BLD reserves the right to disqualify any entrant and/or winner in its absolute discretion.
No purchase is necessary for entrance to any competition. All prizes are non-transferrable and no cash or credit alternatives will be offered. Arrangements for the fulfilment of prizes may be made by a third party sponsor. BLD reserves the right in its sole discretion to substitute any and all prizes with prizes of comparable value.
All entries must be received by the deadline for that competition and late or incomplete entries will be disqualified. By you entering a competition, if you are a winner, you grant BLD permission to use your name and likeness for advertising and future promotional purposes.

By you entering a Competition you:

(a) assign to BLD all rights, title and interest (including, without limitation, all intellectual property rights however arising and in whatever media throughout the world) in perpetuity, in all creative material uploaded onto any of the BLD Sites or otherwise provided by you where such creative material is the subject of the competition;

(b) irrevocably and unconditionally waive on your behalf in perpetuity the benefit of any provision of law known as moral rights of authors of any similar law in any country;

(c) acknowledge that BLD may use such creative material in any way it sees fit without further payment to you;

(d) warrant to BLD that such creative material is wholly original to you (in the sense of not being copied), does not libel, defame, cause injury to, or invade the privacy of or otherwise infringe or violate the rights of any third party and the use of such creative material by BLD will not infringe the rights of any third party; and

(e) consent to BLD passing your name and address to any third party to deliver the prize or prizes to you.

Winner(s) will be notified by e-mail or any other method as BLD shall decide as soon as possible after the competition draw/decision.

For the names of the winner(s), please write to : Mike McMillan, BLD Group Plc, Unit 3A, Carvers Industrial Estate, Southampton Road, Ringwood, BH24 1JR, specifying the competition. If you are a winner, you may have to complete additional legal documents and return them to BLD within five working days of receipt from BLD. Non-compliance or notification returned as undeliverable as addressed will result in your disqualification as a winner and an alternative winner will be selected.

The receipt, by you if you are a winner, of any prize is conditional upon compliance of any and all laws, rules and regulations including, without limitation, the Competition Rules and any further rules relating to such competition as BLD may impose.

Winners are solely responsible for all insurance, applicable taxes and for any expenses not specified in the prize description including those associated incidental expenses associated with claiming the prize.

BLD reserves the right to implement age requirements or other eligibility criteria where necessary. Competitions are not open to the employees of BLD or those of affiliated companies and subsidiaries, nor to any sponsors, nor to the immediate families of such employees or sponsors. Winner(s) of the competitions agree that neither BLD nor its employees or any sponsors shall have any liability in connection with the acceptance or use of any of the prizes awarded herein. No responsibility can be accepted for entries lost of delayed in transmission or for damage or loss resulting from misdirected or incomplete entries arising from transmission and/or computer malfunctions, viruses, bugs or other similar causes.

7. Liability and Indemnity

Nothing in these terms and conditions purports to exclude or limit the liability of BLD for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law.

Whilst every effort is made to verify the accuracy of information displayed on the Site, we make no representation or warranty of any kind regarding the contents or availability. Any indemnities, warranties, terms and conditions are hereby excluded to the fullest extent permitted by applicable law.

Reasonable steps have also been taken to protect the Site, but all users are advised to take all necessary steps to ensure that no virus contamination occurs. No liability can be accepted by BLD for any loss or damage sustained as a consequence of any virus transmission.

BLD will not be liable for any special, indirect or consequential loss (including, but not limited to loss of profits, loss of goodwill or reputation, loss of data) and in any event our liability in aggregate shall be limited to £1,000, our then remaining public liability insurance.

This clause does not affect your statutory rights as a consumer, nor does it affect your cancellation rights.

8. Unauthorised Use of the Site

The following uses (this list is not exhaustive) are explicitly unauthorised, a breach of these conditions and may be an infringement or even a crime:

(a) Any unauthorised use or copying of our name, trading style, getup, confidential information or date (being information of a confidential nature the misuse of which will cause foreseeable damage to our business reputation or goodwill) or copyright material.

(b) Unauthorised entry to any non-public part of the Site, including its underlying codes, or into any private computer system of BLD.

(c) Unauthorised copying, downloading or framing or any part of the Site.

(d) Unauthorised covert or overt linking of any part of the Site with another website or interception of visitors or potential visitors.

(e) Any action which is intended or has the effect of deceiving or misleading us or third parties, whether for gain or otherwise.

9. Miscellaneous Provisions

These Terms and Conditions are governed by English Law and are subject to the exclusive jurisdiction of the English courts.

If any part or parts of these Terms and Conditions are deemed invalid, void or unenforceable, then that part or those parts will be considered severable from these Terms and Conditions thereby not preventing the remainder from being enforceable or effective.

Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or misdescribed goods. For further information about your statutory rights contact your local authority Trading Standards Department or Citizen's Advice Bureau.

You may not assign or sub-contract any of your rights or obligations under these terms and conditions or any related order for products to any third party unless agreed upon in writing by us. These terms and conditions do not create or confer any rights or benefits enforceable by any person that is not a party (within the meaning of the U.K. Contracts (Rights of Third Parties) Act 1999).

BLD reserves the right to transfer, assign, novate or sub-contract the benefit of the whole or part of any of its rights or obligations under these terms and conditions or any related contract to any third party. These terms and conditions including the documents or other sources referred to in these terms and conditions supersede all prior representations understandings and agreements between you and BLD and set forth the entire agreement between you and BLD for use of the Site.

These Terms and Conditions form the entire agreement between You and BLD and take precedence over any communications and representations made either orally, in writing or elsewhere at the Site.

Privacy Policy

The Site may contain links to third party websites. BLD is not responsible for any communication of or transactions between you and any third party sites. BLD is not responsible for the contents of any third party website which is not maintained by BLD. If you have any concerns regarding any third party link, please contact the Customer Service department of that third party site.

1. Data Protection and Privacy

(a)    The personal data that you provide (“the Data”) to BLD is collected for the purpose of:

a)    To provide you with a personalised service to enhance your enjoyment of the Site or any other website operated by an associated company of BLD;
b)    To ensure that content is presented in the most effective manner for your computer;
c)    To allow you to participate in interactive features of our service where you have chosen to do so;
d)    To send you newsletters via e-mail;
e)    To contact you in relation to prize draws and competitions;
f)    To provide you with information and services that you have requested from us;
g)    To update you about changes to the service of the Site;
h)    To contact you with information about the Site or any other website operated by BLD that we think may be of interest to you;
